6. HOW WE DISCLOSE PERSONAL INFORMATION
We may disclose personal information only as reasonably necessary for the purposes described in this Privacy Policy.

We may provide information to vendors and service providers that perform services on our behalf, such as:
- cloud hosting;
- database services;
- authentication;
- email delivery;
- SMS delivery;
- file storage;
- analytics;
- payment processing;
- security;
- customer support;
- infrastructure and technical services.
These providers may process information only as necessary to perform services for TXK PRO and are expected to protect information in accordance with applicable contractual and legal obligations.
IMPORTANT SMS EXCEPTION:
Mobile phone numbers, SMS opt-in data, and SMS messaging consent are not shared with third parties or affiliates for their own marketing or promotional purposes.
6.2 At Your Direction
We may disclose information when you intentionally ask us to share it or when a feature is specifically designed to transmit information to a person or organization you select.
For example, if you submit an application to a particular employer or choose to send profile information to a particular organization, the information you authorize may be provided to that recipient.
SMS consent is not transferred merely because other information is shared at your direction. A recipient that wants to send its own marketing or promotional text messages must obtain any consent required for its own messaging program.
6.3 Legal, Safety, and Compliance Reasons
We may disclose information where we reasonably believe disclosure is necessary to:
- comply with applicable law, regulation, legal process, subpoena, court order, or governmental request;
- investigate fraud, abuse, security issues, or violations;
- protect the rights, property, safety, or security of TXK PRO, our users, or others;
- establish, exercise, or defend legal claims.
6.4 Business Transactions
If TXK PRO is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information may be transferred as part of that transaction subject to applicable law and appropriate safeguards.
Any successor receiving mobile messaging information remains subject to the restrictions described in this Privacy Policy. SMS opt-in consent is not permission for unrelated entities to market to you by text.
6.5 Aggregated or De-Identified Information
We may use or disclose information that has been aggregated or de-identified so that it cannot reasonably be associated with an identifiable individual.
6.6 No Sale of Personal Information for Third-Party Marketing
TXK PRO does not sell your personal information to third parties for their own marketing or promotional purposes.
Most importantly for our messaging program:
WE DO NOT SELL, RENT, SHARE, OR PROVIDE YOUR MOBILE PHONE NUMBER, SMS OPT-IN INFORMATION, OR SMS MESSAGING CONSENT TO THIRD PARTIES OR AFFILIATES FOR THEIR MARKETING OR PROMOTIONAL PURPOSES.
All categories of information disclosure described in this Privacy Policy exclude text messaging originator opt-in data and consent from use by third parties or affiliates for marketing or promotional purposes.
7. DATA RETENTION
We retain personal information for as long as reasonably necessary to:
- provide the Services;
- maintain your account;
- complete the purpose for which the information was collected;
- comply with legal, accounting, operational, or reporting requirements;
- maintain security and audit records;
- prevent fraud or abuse;
- resolve disputes;
- enforce agreements;
- document consent or opt-out requests.
When information is no longer reasonably necessary, we may delete, anonymize, or securely dispose of it, subject to applicable legal requirements and technical limitations.
We may retain limited SMS consent and opt-out records after an opt-out request so that we can honor the request, maintain suppression records, and demonstrate messaging compliance.
8. SMS / TEXT MESSAGING PRIVACY AND CONSENT
This section applies specifically to SMS and MMS messaging from TXK PRO.
8.1 How Users Opt In
TXK PRO sends recurring SMS or MMS messages only where the recipient has provided the consent required for the applicable messaging program.
Where consent is collected through a website or web form, the SMS consent control is intended to be presented separately from other agreements and must be actively selected by the user. The SMS consent checkbox must not be pre-checked by default.
Where SMS consent is optional in connection with another service, declining SMS consent will not prevent the user from completing the underlying action solely because they declined promotional or informational SMS messaging.
Consent to receive marketing or promotional SMS messages is not a condition of purchasing goods or services.
8.2 Types of Messages
Depending on the program and the consent you provide, TXK PRO text messages may include:
- account or service notifications;
- application or opportunity updates;
- scheduling and reminder messages;
- program or event information;
- support communications;
- transactional or operational updates;
- promotional information where you have expressly opted in to receive such messages.
The actual message types you receive will depend on the specific SMS program for which you opted in.
8.3 Message Frequency
Message frequency varies based on your activity, the TXK PRO program, and the communications you have requested or consented to receive.
8.4 Message and Data Rates
MESSAGE AND DATA RATES MAY APPLY.
Your mobile carrier may charge fees for sending or receiving SMS or MMS messages according to your wireless plan.
8.5 How to Opt Out
You may opt out of TXK PRO SMS messages at any time by replying:
STOP
to a TXK PRO text message.
After an opt-out request is processed, you may receive a final confirmation message. You will not receive additional messages from that SMS program unless you later provide new consent or otherwise re-enroll in accordance with applicable requirements.
Other recognized opt-out keywords may also be honored where supported by our messaging provider.
8.6 How to Get Help
For SMS assistance, reply:
HELP
to a TXK PRO text message, or contact us at:
hello@txkpro.com
8.7 SMS Non-Sharing Statement
TXK PRO does not share, sell, rent, transfer, or provide your mobile phone number, SMS opt-in data, or SMS messaging consent to third parties or affiliates for their own marketing or promotional purposes.
Mobile information and messaging consent are used only for purposes related to the TXK PRO messaging program for which consent was provided and for service providers acting on TXK PRO's behalf to operate or support that messaging program.
Text messaging originator opt-in data and consent are excluded from any disclosure to third parties or affiliates for marketing or promotional use.
8.8 Messaging Service Providers
We may use communications service providers to transmit messages and administer the technical operation of our SMS program. Such providers may process mobile numbers and message-related data solely as necessary to provide services to TXK PRO.
Use of a communications service provider to deliver TXK PRO messages does not authorize that provider to use your SMS consent for its own marketing or promotional purposes.
8.9 Carrier Responsibility
Wireless carriers are not responsible for delayed or undelivered messages.
8.10 Revoking Consent
You may revoke SMS consent at any time using the opt-out instructions above. Revoking SMS consent does not necessarily close your TXK PRO account or prevent you from using non-SMS Services.
We may also stop sending messages if a number is invalid, reassigned, blocked, or otherwise unavailable.
9. COMMUNICATION PREFERENCES
You may manage communications in the manner provided by the applicable communication.
For SMS:
Reply STOP to opt out.
For email marketing:
Use the unsubscribe link included in the applicable marketing email, where available.
You may still receive communications that are necessary to provide a requested service, respond to you, maintain security, or comply with legal obligations, subject to applicable law and the communication channel involved.
10. SECURITY
TXK PRO uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.
These measures may include, as appropriate:
- access controls;
- authentication;
- role-based permissions;
- encrypted communications;
- restricted administrative access;
- logging and monitoring;
- secure hosting and storage practices;
- vendor controls;
- backup and recovery practices.
No electronic transmission, storage system, or online service can be guaranteed to be completely secure. You are responsible for protecting your account credentials and notifying us if you suspect unauthorized access to your account.
11. YOUR PRIVACY CHOICES AND RIGHTS
Depending on where you live and the laws that apply, you may have rights regarding your personal information, which may include the right to:
- request access to personal information we maintain about you;
- request correction of inaccurate information;
- request deletion of certain personal information;
- request information about how personal information is used or disclosed;
- withdraw consent where processing is based on consent;
- opt out of certain communications.
These rights may be subject to exceptions or limitations under applicable law.
To submit a privacy request, contact:
hello@txkpro.com
We may need to verify your identity before completing a request. We will not discriminate against you for exercising privacy rights provided by applicable law.
12. STATE-SPECIFIC PRIVACY RIGHTS
Residents of certain U.S. states may have additional privacy rights under state law.
Where applicable, TXK PRO will provide the access, correction, deletion, appeal, opt-out, or other rights required by law.
Nothing in this section changes our SMS commitment: mobile phone numbers, SMS opt-in data, and SMS consent are not sold or shared with third parties or affiliates for their own marketing or promotional purposes.
13. CHILDREN'S PRIVACY
TXK PRO does not knowingly collect personal information from children under 13 through general consumer Services without appropriate authorization where required by law.
Some TXK PRO programs may involve students or younger users. Where a specific service is provided through or in cooperation with a school, parent, guardian, training program, or other authorized organization, additional consent, contractual, or legal requirements may apply.
If you believe a child under 13 has provided personal information to TXK PRO inappropriately, contact us at hello@txkpro.com so we can review the matter.
14. THIRD-PARTY LINKS AND SERVICES
The Services may contain links to third-party websites, tools, job postings, organizations, payment services, social platforms, or other external resources.
TXK PRO does not control the privacy practices of independent third parties. Review the privacy policy of the third-party service before providing information to it.
A link from TXK PRO to a third-party service does not authorize that third party to use your TXK PRO SMS consent for its own messaging or marketing program.
15. DATA TRANSFERS
Our service providers may process information in locations different from where you live. Where required, we take reasonable steps designed to ensure that appropriate protections are in place for personal information transferred or processed across jurisdictions.
16. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect:
- changes to our Services;
- legal or regulatory requirements;
- changes to our privacy practices;
- changes to our messaging program;
- security or operational improvements.
When we make material changes, we will update the "Last Updated" date above and may provide additional notice where appropriate or required.
Changes to this Privacy Policy do not retroactively create SMS marketing consent where consent is legally required. If a new messaging purpose requires new consent, TXK PRO will obtain that consent as required.
